terms and conditions.

created and designed by MIS Promotions, Mark I. Sikand.
The "Home Page" and "Control Pages"
are semi customized for your company. Our "Master
Website" template is used to create all the websites
that we produce for ALL Jewelers.
You are purchasing a license to use ONE COPY of our jewelers
website software product subject to your agreement with
the User Terms and Conditions, You may NOT copy or
reproduce our software, our programming, our website or
our program or any of its contents with out our EXPRESSED
WRITTEN PERMISSION and paying for an additional user
licensing fees.
This website layout and design is
owned by Mark I Sikand, MIS Promotions of 140 Regency Park
Dr, Agawam MA 01030, copyright 2005,
2009 All rights reserved. It is agreed that your company may
use ONE COPY of the website indefinitely, free of additional charge,
fees or royalty’s of any kind to Mark I Sikand, MIS
Promotions, to sell jewelry and other related jewelry products, promote
sales or the business and may make updates and changes to
the website at any time for as long as the business is
owned by the current owners or an immediate family member.
The website may not be sold or leased; it may not be
included with the sale, lease or transfer of the business
with out paying a licensing transfer fee to Mark I. Sikand, if surviving,
otherwise, heirs. It is agreed that at all times the name
and logo of ogoweb.com ,the copyright information, the
page insert banner and the working link will
appear on the website as it currently does at the bottom
of each page. In the event of a sale, lease or transfer to
a third party, these terms and conditions will be included
and imposed to the new party, in writing.
Your company and you: - are
responsible for all of the content of the website
including but not limited to copyright infringements or
other Federal or State Laws that may apply, -
has reviewed the content of the website prior to
publishing it to their website(s), - are the publisher of
the website to the Internet and if we published your
website for you, it was at your request and directive
and we were only acting as your agent, - are responsible for all
cost associated with the website, including but not
limited to: hosting, advertising, marketing, promotions,
security, development, maintenance, updating, Internet listings,
software, other, - agrees to hold harmless, defend and
indemnify Mark I. Sikand, MIS Promotions from all claims
or legal action of any nature made by any person or party,
at any time, and further agrees to indemnify Mark I.
Sikand, MIS Promotions, for any losses, fees, costs,
judgments, settlements (including legal fees), which may
arise as a result of any claim(s) or lawsuits made by any
person or party, regarding the website or any aspect of
it.
You are responsible to add ALL
product images, descriptions and prices. Product images
on your website are not included as part of the sale,
they are for display and presentation use only and are
not intended for you to publish on to the internet, the
product images may be copyright protected by third
parties. It is your obligation to either delete such
product images or get permission to use them prior to
publishing your website.
This website layout and design is in
use and has been published by Mark I Sikand and it is also
being sold to other jewelers and businesses by Mark I.
Sikand, MIS Promotions. In addition, its development is an
on going process. No two websites will be 100% identical.
Not all areas of the website are completed and or fully
working. Keep in mind that you have the capability and
flexibility to change colors, graphics, pictures,
products, backgrounds, text color and font and so much
more. Your website was developed
using Microsoft Frontpage Software. It is your
responsibility to purchase software necessary to edit,
publish, develop and make changes to your website, such
software is not included in your purchase.
